Renting Out Your Riverbank ADU: Owner-Occupancy Rules, Rental Restrictions, and What the County Actually Enforces

September 15, 2026

You permitted the ADU, financed it, and picked a floor plan. Before you list it for rent or move a family member in, Stanislaus County and the City of Riverbank have a separate set of rules about who can actually live in that unit — and getting this wrong after the fact is a lot more expensive than checking it before you build.

Owner-occupancy: what changed and what's still true

For years, California required the property owner to live in either the primary home or the ADU before renting the other one out. State law has since removed that owner-occupancy requirement for most standard ADUs built under the current streamlined process — but Riverbank's local ordinance can still apply its own conditions, and Junior ADUs (JADUs) built by converting existing space inside the primary home are treated differently than a detached, county-approved ADU. If you're deciding between build types, that distinction is worth weighing alongside the cost and lot-fit questions we covered in Detached, Attached, Garage Conversion or JADU.

The rule that trips people up: whatever occupancy condition was attached to your permit at approval is the one that governs your unit, not whatever the general state law says today. Confirm the actual condition on your approved permit before you sign a lease.

Long-term rental vs. short-term rental

A long-term lease (month-to-month or longer) is generally the straightforward path once your ADU has final inspection sign-off. Short-term rentals — the kind listed on a nightly booking platform — are a different story. Riverbank and Stanislaus County can restrict or outright prohibit short-term rental use of an ADU separately from the building permit itself, sometimes requiring a separate business license or rental registration. Don't assume a completed, permitted ADU is automatically clear to list on a booking site; check the current short-term rental ordinance for your specific parcel before you take a booking.

What the county actually checks after you're renting

  • Final inspection and certificate of occupancy — no legal tenant, long-term or short-term, until this is on file.
  • Address assignment — a rented ADU needs its own mailing address distinct from the primary home for utilities, mail, and emergency response.
  • Parking — most Riverbank ADU approvals include a parking condition tied to the unit; adding a tenant with a second vehicle can trigger a review if the site plan didn't account for it.
  • Utility metering — whether your ADU is separately metered or shares utilities with the main house affects how you can legally structure rent, and it's worth locking down during construction rather than retrofitting later.

None of this is meant to talk you out of renting — workforce and family housing is exactly why ADUs pencil out in Riverbank the way they don't in more expensive markets, a comparison we laid out in what a county-approved ADU really costs. It just means the rental conditions belong in the same conversation as the permit, the financing, and the build itself — not a surprise after your first tenant moves in.

Start with the permit conditions, not the listing

If you're still early enough to shape how your ADU gets approved, tell us up front that renting is the plan — long-term or short-term — so we can build the occupancy and parking conditions into the permit application instead of fighting them afterward. We walked through the full permitting process in County-Approved ADUs in Riverbank, California. Contact us and we'll walk your lot through it before you're locked into a floor plan that doesn't fit your rental plans.
